DMCA Policy

With Tether Inc. (“Tether”) respects the intellectual property rights of others, takes the protection of intellectual property rights seriously, and requires that users of its platform do the same. Infringing activity will not be tolerated on or through Tether’s platform or any white-label community, site, or application powered by Tether (collectively, the “Service”).

This DMCA Policy is incorporated into the Tether Terms of Service and governs how copyright complaints are submitted and processed.

1. DMCA Notification

Tether complies with the provisions of the Digital Millennium Copyright Act applicable to online service providers (17 U.S.C. § 512). If you believe that any material available on or through the Service infringes copyright you own or control, please send a written Notification of Claimed Infringement to Tether’s designated DMCA agent:

2. Procedure for Reporting Claimed Infringement

Your Notification of Claimed Infringement must include all of the following:

  1. A physical or electronic signature of the person authorized to act on behalf of the copyright owner.
  2. A description of the copyrighted work you claim has been infringed.
  3. A description of the material you claim is infringing and its location on the Service.
  4. Your full name, address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information provided is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on their behalf.

Tether may provide copies of your notice to the user who posted the alleged infringing content and to third-party databases that track DMCA takedown notices. Consult an attorney or 17 U.S.C. § 512 to ensure your notice is valid.

3. Repeat Infringers

It is Tether’s policy to:

  • Remove or disable access to content that Tether believes in good faith infringes a third party’s copyright; and
  • In appropriate circumstances, terminate the accounts of users determined to be repeat infringers.

Tether reserves the right, in its sole discretion, to suspend or terminate any user account for infringement or other violations of the Terms of Service.

4. Counter Notification

If you believe that content you posted was removed in error or misidentification, you may submit a Counter Notification to the DMCA Agent listed above. A valid Counter Notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material removed or disabled, including where it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed due to mistake or misidentification.
  4. Your name, address, and telephone number, and a statement consenting to the jurisdiction of the Federal District Court for your judicial district (or any district where Tether may be found if you are outside the U.S.), and agreeing to accept service of process from the party who sent the original DMCA notice.

You should consult a lawyer or 17 U.S.C. § 512 to confirm your obligations.

5. Restoration of Content After Counter Notification

When Tether receives a valid Counter Notification, it will:

  • Provide a copy to the party who sent the original DMCA notice;
  • Inform them that the removed content may be restored within 10 business days; and
  • Restore the removed content between 10 and 14 business days after receiving the Counter Notification, unless Tether first receives notice that the copyright claimant has filed a legal action seeking a court order to prevent the user from engaging in infringing activity.

6. False Claims

Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents:

  • That content is infringing, or
  • That content was removed by mistake or misidentification

may be liable for damages, including attorneys’ fees and costs. Tether reserves the right to seek damages from any individual or entity that submits false or fraudulent DMCA Notifications or Counter Notifications.
